Definitions

“Personal data” or “Data” means any information relating to an identified or identifiable natural person; an “identifiable” natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

“Data controller” means the natural or legal person which, alone or jointly with others, determines the purposes and means of the processing of personal data.

The Data we collect about you

To best represent you, AMM collects and stores some of your personal Data, including:

  • Personally identifiable information such as surnames, forenames, email addresses, phone numbers and other contact details;

  • Physical data: weight, height, body measurements, tattoo(s), piercing(s), hairstyle (cut and colour), eye colour; photographs;

  • Social security number; date of birth;

  • Medical certificates (no medical information);

  • Birth certificate for obtaining social security numbers for non-French models;

AMM has taken the necessary technical and organizational measures to ensure that your Data is processed in complete confidentiality and security.

Recipients and purposes of data processing

Within AMM, the following may receive your Data:

  • The Booking Department: to represent and place you.

  • The Administrative Department: to complete the necessary formalities, meet our legal and regulatory obligations, and pay you.

We may also for the purposes of our legitimate interest:

  • post photographs featuring you online and on social media in the aim of promoting the agency,

  • use your image for non-commercial purposes (internal documentation, social media, agency website, etc.) or for archival or documentary purposes.

Finally, we may share your Data with:

  • Clients or potential clients in order to finalize labour supply contracts or contracts for the transfer of image rights concerning you;

  • The company AMM if it is also authorized to represent you;

  • Agencies outside France to find you contracts;

  • Photographers and printers to complete your portfolio or other photoshoots;

  • Organizations acting as subcontractors (e.g. visa service providers, travel agencies to book you flights and/or accommodation, debt recovery companies, etc.);

  • Certain government entities to meet our legal obligations;

  • Auditors, consultants or potential acquirers prior to an audit or restructuring;

  • IT companies such as software providers we use may also have access to your Data but only for the purposes of hosting and supporting our tools.

Agency clients working with our models may also process certain Data. They are data controllers as defined by the GDPR. AMM is not responsible for how they use your personal Data. For more information, you should contact them directly.

What are our policies regarding children?

Registrants must be eighteen (18) years of age or older in order to independently submit an Application to us. Registrants may be under eighteen (18) years of age if their parent/legal guardian registers on their behalf; however, Registrants may in no case be under thirteen (13) years of age. AMM does not knowingly collect Personal Information from anyone under thirteen (13) years of age and no part of our website is designed to attract anyone under age thirteen (13). Please do not communicate with or contact us if you are under age thirteen (13).

Data transfers outside the European Union

Depending on the circumstances, we may transfer personal information outside the European Economic Area to countries with less stringent Data protection laws. Appropriate preventive measures will be taken when that type of transfer is required.

When signing your contract with our agency, you can choose whether or not to allow your data to be transferred to clients or agencies located outside the European Union.

Data storage period

AMM stores your Data for five years from the end of the last client contract involving you. Certain Data or documents providing evidence of your pension entitlement or with tax ramifications may be stored for ten years. Your photographs will be stored for twenty years. AMM may store a small number of photographs for longer periods for its own archives in order to maintain a record of company models. Your rights

You have the right to request access to and rectification of your personal data, the right to data portability and, where there are legitimate grounds, the right to object, to restrict processing and to erasure. You also have the right to determine what happens to your data after your death. You can exercise these rights by emailing hello@awake-mgmt.com.

If you have any concerns over how your personal data is being used, you can contact us or lodge a complaint the French Data Protection Authority (CNIL).
